The Comal County Magistrate Court handles the first judicial review after arrest. This is where the judge reviews probable cause, informs the defendant of the accusation and legal rights, considers bail and conditions of release, and handles requests for court-appointed counsel.

Check the exact payment rule before buying a money order
Cash bond
Although it is called a “cash bond,” the current county instructions say cash bonds and fines must be paid using a money order or cashier’s check for the exact amount.
- Payment is made in person at the jail.
- Overpayment cannot be accepted.
- More than one money order or cashier’s check may be combined.
- The county currently says it does not accept wire transfers or internet bond payments.
Surety bond
A licensed bail-bond company posts the bond after the defendant or another person makes arrangements with the company.
- Comal County is a Bail Bond Board county.
- Companies must be licensed to post bonds.
- The approved-company list rotates weekly.
- Sheriff’s employees cannot recommend a company.
Personal bond
A qualifying defendant may be released without posting the face amount of a cash or surety bond when the court grants a personal bond.
Personal bond is a judicial decision; family members cannot simply request it from a detention officer.

Do this on the same day when possible. A release or transfer can make an existing visit plan useless.

Comal County uses an appointed-lawyer system
A defendant who cannot afford an attorney can request court-appointed counsel during or after magistration by completing an affidavit of indigence and attorney application.
Misdemeanor case
The Magistrate Court can make appointments in unfiled misdemeanor cases under the county’s indigent-defense plan.
Felony case
