A dismissed row can coexist with active custody. If one charge says “DISMISSED” but another row says “PENDING DISPOSITION,” shows a bond, or reflects another hold, do not assume the person is being released.

Getting a cash bond back after the case ends

Midland County’s Sheriff FAQ says a cash bond is receipted to the defendant and only the defendant may receive the refund. When the criminal case was filed, the money is generally deposited with the clerk of that court. If the case was dismissed before court filing or indictment, the jail may handle the refund. Keep the bond receipt, court paperwork showing the resolution and government-issued ID.

Special rule for children under 17

Midland County publishes an unusually specific child-visitation rule. Sons, daughters, stepsons and stepdaughters under 17 may visit their incarcerated parent during the first full visitation week of each month, defined by the county as the first Saturday through Tuesday in the same month. Only one child may visit at a time, the child must remain with a parent or guardian, and the visit counts as one of the inmate’s two visits that day. A liability release is required before the child’s first visit.

When the inmate does not want to list the child’s guardian, Midland County says the guardian must provide letters of guardianship to the Detention Division.

Booking photographs are not simply an open public gallery

Midland County’s current booking-photo form is specifically a media request form. The county states that written requests are handled Monday–Friday from 9:00 a.m.–5:00 p.m. and require the defendant’s name, DOB and/or SPN, and criminal charge. The form also states that photographs for people not arrested by MCSO, or people no longer in custody whose case did not result in a criminal conviction, will not be released through that process.
